Shipping Policy

• Only orders for delivery within Australia are accepted.
• Orders received before 12 noon will usually be shipped within the next working day of your order being placed.
• All orders will include a non-refundable flat rate of AUD$11.95 postal and handling fee per order. 

Product Returns

• For personal hygiene reasons, Air Liquide Healthcare has a strict no return policy for all medical products.
• In the event of receiving faulty product or if goods are damaged during transit, please advise us of this by email or telephone on (02) 9364 7474, within 5 working days of goods being received. 

General Terms & Conditions

• All orders are subject to our full Terms & Conditions of sale.
• All goods remain the property of Air Liquide Healthcare Pty Ltd until full payment is received. 

Availability

• All products offered on this website are subject to change and availability.
• In the event that a product should become unavailable, due to unforeseen circumstances, an Air Liquide Healthcare customer service representative will contact you in person within the next working day of your order being placed. 

Pricing

• All prices and offers are subject to change and availability.
• All amounts set out in this Order Form include GST where applicable, and all final invoices will include a GST breakdown. However, most Medical Products are GST exempt. If you believe that you are GST exempt, please discuss this with us by email or telephone on (02) 9364 7474. 

Consumables

• You have purchased the Consumables and must pay us the Purchase Price. Risk in the Consumables passes to you on delivery, while we retain title until you have fully paid the Purchase Price. For subsequent purchases, you will be charged our standard retail price as amended from time to time. 

Medical Advice

• You acknowledge that: (a) we have not provided you with any medical advice and have made no representations in relation to the suitability of the Equipment or the Consumables for your medical condition; and (b) in this regard, you have obtained, will continue to obtain and will comply with medical advice from a qualified medical practitioner.

 

Instructions and Safety

• You acknowledge that we have explained and provided you with (and you have read and understood) full instructions in respect of the maintenance, possession and use of the Equipment and Consumables. You must (a) only use them strictly for their intended purpose and in accordance with those documents; and (b) immediately advise us of any defect in the Equipment.

 

Liability and Indemnity

• We are not liable to you in any circumstances for: (a) any economic loss or damage including, any loss of revenue, profits, actual or potential business opportunities, contracts or anticipated savings or profits; (b) any indirect or consequential loss or damage; or (c) any loss or damage relating to the acts or omissions of any third party, and all other matters beyond our control.
• To the extent permitted by law, we exclude all liability for breach of any express or implied term or warranty and also exclude all liability for negligence in respect of the performance of our obligations under this Agreement.
• Where liability for any term implied by law cannot be excluded, and to the extent permitted by law, our liability for any breach of such an implied term is limited to (at our election): (a) in the case of services - the cost of having the services supplied again; and (b) in the case of goods - the lowest of the cost of replacing the goods, acquiring equivalent goods or having the goods repaired.
• You must indemnify us against any damage, expense, loss or liability suffered or incurred in respect of your possession or use of the Equipment and the Consumables, unless and to the extent caused by our negligence.

 

Privacy

• You: (a) acknowledge that you have read our Privacy Policy; and (b) authorise us to collect, use and disclose your personal information only in accordance with that policy.

 

Other Matters

• Any provision of this Agreement that is illegal or unenforceable will be severed without affecting any other provision.
• We may at any time assign this Agreement. However, if this would be detrimental to you, we may only do so with your prior consent.
• All variations to this Agreement must be in approved by both parties. This Agreement is governed by the laws of New South Wales, Australia.
